About these terms
These terms apply when you book a delivery or removal with Eaglix Freight Ltd ("Eaglix", "we", "us"), a company registered in England and Wales at 73 Norman Street, Birmingham B18 7ER, and when you use our website, the Eaglix business portal, the Eaglix Freight app, the Eaglix Driver app or the Eaglix API.
If your company has a signed account agreement with us, that agreement takes priority where it differs from these terms. Questions? Email info@eaglixfreight.co.uk or call 07438 569191.
Accounts and logins
Business accounts are opened for a company. The person who opens the account is its owner and can add colleagues as admins, bookers or viewers. Everyone who signs in must use their own login and keep their password private. You are responsible for bookings made with your company's logins and API keys.
We can pause online booking or close an account if it is misused, if invoices are seriously overdue, or if we are required to by law. We will tell you why unless the law prevents us.
Prices and bookings
The price shown before you confirm is based on the details you give us: addresses, service, date, number of vans, and the size or weight of the goods. A booking is confirmed when you see the confirmation in the portal, the app, by email or through the API.
The price can change if the job turns out to be different from what was booked, for example:
- the goods are bigger, heavier or more numerous than described, or need extra people or equipment;
- the driver has to wait longer than a reasonable loading or unloading time, or the collection or delivery is not ready;
- extra stops, a different address, or charges such as tolls, congestion or parking that were not part of the booking.
We will tell you about any extra charge as soon as we can and, where possible, before the work is done.
Your part
When you book, you agree to:
- give accurate addresses, contact details on the day, access information and a fair description of the goods;
- have the goods packed, labelled and ready at the booked time, and someone available at collection and delivery;
- make sure you are allowed to send the goods and that they are safe and legal to carry.
We do not carry dangerous or hazardous goods (unless agreed in writing beforehand), illegal items, live animals, cash, jewellery, or items of exceptional value. Tell us before you book if you are unsure.
Changes and cancellations
You can cancel a booking free of charge in the portal, the app or through the API until a driver has been booked for it. After that, call us on 07438 569191. If a driver is already on the way or has arrived, we may charge for the work and costs already incurred.
If we cannot carry out a booking, for example because of severe weather, road closures or a breakdown, we will tell you as soon as possible and agree a new time or cancel without charge.
Collection and delivery
Collection and delivery times are our best estimate, and we work hard to meet them. Live tracking shows where your van is while a job is in progress. Every job is carried out by an Eaglix driver who has been checked and is insured before they can take work with us. A delivery is complete when the goods are handed over at the delivery address, or left as you instructed, and proof of delivery is recorded.
Payment
There is nothing to pay in the apps. Jobs are invoiced to your company on the payment terms agreed for your account, or per job if no terms are agreed. Your quote and invoice show the price and any VAT. Invoices are due by the date shown on them. We may pause online booking for accounts with overdue invoices.
Loss, damage and insurance
We look after your goods from collection until delivery. We make sure every driver who carries out a job for us holds their own insurance, and Eaglix Freight Ltd also holds company goods in transit and liability insurance.
You can ask for our insurance details, or those of the driver on your job, at any time by emailing info@eaglixfreight.co.uk or calling 07438 569191. If your goods need a higher level of cover than standard, tell us before you book and we will confirm what we can arrange.
If something is lost or damaged while in our care, tell us in writing within 7 days of delivery (or of the expected delivery date if the goods did not arrive), with photos where you can. We will deal with your claim through the driver's insurance or our own.
Our liability for loss of or damage to goods is limited to the amount stated in your quote or account agreement or, where none is stated, to the limit of our goods in transit insurance for that job. We are not liable for indirect or consequential losses such as lost profit, lost business or late-delivery penalties, or for loss or damage caused by poor packing, an inaccurate description of the goods, or goods we were not told about.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
The Eaglix API
API keys are for your company's own systems. Keep them secret, revoke any key you think has been exposed, and use the API at a fair rate (see the developer documentation). Bookings made through the API are real bookings on these terms. We may suspend a key that is misused or that puts our service at risk.
Drivers using the Eaglix Driver app
Drivers use the Eaglix Driver app under their separate agreement with Eaglix. Prices you bid or accept in the app are for the job as described. You must hold valid insurance for the work you do with us, share your insurance details with Eaglix when asked, keep your documents and vehicle details up to date, and only share your location for the jobs you are doing.
Using our website and apps
You may use our website and apps for their intended purpose. Do not try to access other companies' data, interfere with the service, or copy or resell it. We keep the apps up to date and available, but we cannot promise they will always be free of faults or interruptions. How we handle personal information is explained in our privacy policy.
Changes to these terms and the law that applies
We may update these terms; the date at the top shows the latest version, and bookings are covered by the terms in force when they were made. These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
